Checking the assignment chain on your loan
Line up the note, deed of trust and assignments and note questions for a lawyer.
Check the assignment chain
Line up the note, deed of trust and every recorded assignment to see who says they may foreclose — and write down gaps to ask about.
- 1
Start with the deed of trust
Note the original lender, the beneficiary (sometimes MERS as nominee) and the trustee.
- 2
Add each assignment in date order
Each should transfer from the last holder to the next. Note the signer, date signed and date recorded.
- 3
Compare with the notice of sale
The notice names the mortgagee and servicer. Does it match the last assignment? A mismatch is a question for a lawyer — not proof that anything is wrong.
- 4
Answer the standing question
Record what you found in the eight questions (standing / chain of title).
You search your own records. Techoclaro does not look up people.
